Both the Ctrl+Shift+N shortcut and going up top to the layer menu make it pop up.
The small panel button in the layer panel(the one you can move around) doesn't make it pop up actually, but clicking that with a small size tablet is just as time consuming :s
I've looked on google but couldn't find anyone else having this issue strangly, that or they are buried under all the "HOW DO U MAK LAYEERS??" posts on forums :-/
