Annoying New Layer Prompt

Hey guys, in cs6 each time I click to make a new layer it opens a prompt asking if I want to make it a overlay/color/ect. This is annoying me to a great deal as it is a extra button I have to click with my mouse, I've never seen anyone else have this pop up in their streams so I'm wondering if there is a way to hide it I just can't seem to find?

oh.. i've no idea how / if you can turn it off.
are you clicking the new layer button bellow the layers list or do you go to layers - new layer?

i usually just hit Shift Ctrl N Enter really fast.

Both the Ctrl+Shift+N shortcut and going up top to the layer menu make it pop up.
The small panel button in the layer panel(the one you can move around) doesn't make it pop up actually, but clicking that with a small size tablet is just as time consuming :s
I've looked on google but couldn't find anyone else having this issue strangly, that or they are buried under all the "HOW DO U MAK LAYEERS??" posts on forums :-/
